End of the Light Commercial Vehicle Tax Advantage for Private Individuals in Belgium: BIV and Road Tax Rules
Évolution Législative January 2026 • Belgian Regional Regulations
This guide has been reviewed and updated to incorporate all Belgian vehicle tax reforms in effect as of January 2026.

For decades, registering a vehicle as a light commercial vehicle (European category N1 / lichte vracht / utilitaire léger) was the most effective legal tax shelter in Belgium. By purchasing a heavy American pickup truck or converting a family SUV into a two-seater cargo carrier, a private buyer could completely bypass the one-off registration tax (BIV / TMC) and pay a nominal annual road tax capped at roughly €120 to €160 per year. That preferential era for private individuals has now officially come to an end.

1. The Legislative Turning Point of January 1, 2023 in Flanders

Driven by environmental policy and budget sustainability, the Flemish Government enacted the Decree of December 23, 2022 to curb the widespread use of heavy, high-emission commercial vehicles for purely private and recreational purposes.

Effective January 1, 2023, private individuals residing in the Flemish Region can no longer claim preferential commercial vehicle tax status when registering an LCV.

Mandatory requirement to retain commercial vehicle tax status in Flanders:

The registered keeper must be either a legal corporate entity (company) or a natural person registered with the Crossroads Bank for Enterprises (CBE / KBO) with an active VAT/business number demonstrating genuine economic use.

For private motorists without an active business registration, the vehicle is taxed identically to a standard passenger car (category M1).

Consequently, both the entry registration tax (BIV) and the annual road tax are computed using the Flemish green formula based on:

  • Official WLTP CO₂ emission ratings (g/km).
  • European emission standard (Euro 6d, Euro 6e, etc.).
  • Fuel type (diesel, petrol, LPG, hybrid, or electric).
  • Engine displacement (cc) and fiscal horsepower (CV).

3. Rules in Wallonia and Brussels

Currently, private individuals living in Wallonia or Brussels may still benefit from commercial vehicle taxation, provided the vehicle meets strict federal technical conformity standards:

  • Single-cab pickups: Up to 2 seats, open cargo bed separated from the cabin.
  • Double-cab pickups (50% wheelbase ratio): The usable cargo bed length must equal at least 50% of the vehicle wheelbase. If shorter, the pickup is automatically taxed as a passenger car, triggering full Walloon eco-malus penalties!
  • Van conversions: Rear seats and seatbelt anchorages must be permanently removed, with a flat horizontal cargo floor and a fixed barrier of at least 20 cm in height.

4. Grandfathering Rights for Pre-2023 Registrations

Private individuals in Flanders who registered their commercial vehicle prior to January 1, 2023 maintain their preferential tax status as long as the vehicle remains registered under the same owner and licence plate.
